Among those most likely to seek a fresh start are from groups disproportionately affected by last year’s labor-market disruption: younger and older workers, and women—particularly Black women. As hiring remains slow, the process of applicant selection becomes a pressure point—making the design and operation of hiring systems more visible than in growth cycles.

This reliance on early screening is increasingly visible, and sets the stage for understanding how AI-driven systems impact eligibility—often well before any human assessment occurs.
How AI Screening Narrows Eligibility
Anyone who has worked with AI tools understands that they require direction, oversight and continual evaluation. Hiring is no exception. When AI screening operates without transparency or human review, it can introduce more risk than value.
Given the collective action status of Mobley v. Workday, Inc., alleging that AI-based hiring systems unlawfully screened out qualified applicants, including applicants age 40 and older, the reliance on current AI screening processes is under intense scrutiny.
Most AI-driven hiring tools are trained on historical data that reflects past preferences, exclusions and assumptions about what a qualified candidate looks like. Without human intervention, AI does not challenge those patterns—it scales them. Research shows that AI hiring systems often “inherit or exacerbate human biases embedded in their training data,” because models trained on old resumes repeat past patterns rather than question them.
Removing explicit variables such as age, gender or race does not make a system neutral. Automated models infer demographic information in resumes and applications, including years of experience, employment gaps, names, affiliations, language patterns and even zip codes. Legal scholars Solon Barocas and Andrew Selbst have shown that “seemingly neutral data can serve as a proxy for protected characteristics,” allowing algorithmic systems to indirectly reproduce bias. Regulators and researchers have long cautioned that removing protected characteristics does not eliminate these risks.
One of the most documented failure points is experience-based filtering. Many screening tools deprioritize or eliminate candidates based on experience-related signals, which can function as indirect age proxies that narrow eligibility. Research by labor economist David Neumark has shown that experience-related signals embedded in resumes function as indirect age filters in hiring decisions, even when age is never explicitly considered. Similar concerns have surfaced in enforcement actions, including an age-discrimination in hiring case brought by the Equal Employment Opportunity Commission involving automated hiring rules that screened out older applicants. Those charges resulted in a settlement for an undisclosed amount.
When Scale and Opacity Are Magnified
Demographic bias can also appear through name-based and contextual signals. Studies show automated screening systems may downgrade resumes linked to certain races or genders or penalize gaps for caregiving or health events. For example, research from the University of Washington found that AI models ranked resumes with White-associated names more often than those with Black-associated names, even when qualifications were identical. Simulations by the Brookings Institution and academic analysis of large language model resume screening similarly show systemic bias based on inferred demographic signals, indicating that some AI systems reproduce structural biases embedded in the data on which they were trained.
These dynamics are magnified by scale. A flawed human decision may affect a single candidate. A flawed algorithm can quietly exclude thousands before anyone notices.
Compounding the problem, many AI hiring tools lack practical explainability, making it difficult for employers to understand why specific candidates were screened out—or to document and defend the fairness of those decisions if challenged. As the Brookings research discussed earlier shows, even advanced screening systems can produce outcome patterns that are difficult to audit at the individual level because there are no clear, interpretable decision rationales.
Why Human Review Often Arrives Too Late
These factors become more consequential during periods of slowed hiring. When fewer roles are approved, and applicant volume per role increases, greater care is often given to the final decisions– but only after early screening systems and role design choices have already narrowed the candidate pool.
That timing matters. Greater scrutiny at the end of the process does not offset constraints applied earlier. As a result, exposure to legal complaints about demographic patterns may increase when human review occurs only after early screening has already narrowed eligible candidates for consideration.
As the Mobley v. Workday, Inc lawsuit illustrates, unresolved questions about accountability tend to surface only after exclusionary patterns are already baked into the process. This fact underscores that earlier leadership decisions matter long before accountability is tested. The takeaway is straightforward: AI should support human judgment, not replace it. Responsible use requires clear guardrails, regular audits for bias and reliability and human review at key decision points throughout the process of determining candidate eligibility.
Narrowly Defined Roles And Experience Limits
Hiring constraints do not come only from technology. They start with assumptions about role requirements, what experience should look like and who might fit. Narrow job definitions, rigid requirements and culture-fit screening replicate access constraints like AI, but with more legitimacy and less scrutiny.
Many jobs are designed for precision over adaptability. Narrowly defined responsibilities and rigid experience requirements prioritize linear career paths and uninterrupted tenure, filtering out candidates whose skills were built across roles, industries and life stages. In practice, experience limits are used to reduce applicant pools not by capability, but by conformity to an outdated career trajectory that no longer reflects how careers unfold.
In slowed hiring cycles, early role design and AI screening do most of the selecting. This happens long before candidates reach stages with human judgment. In 2026, employers face a challenge: their early decisions about job design and screening decide who is seen. This leads to demographic exclusion becoming evident late, when it is harder to defend.
