Rob Bonta Sues Five Cities Over Housing Law
California Attorney General Rob Bonta has filed enforcement actions against five cities accused of failing to adopt housing plans that comply with California’s Housing Element Law.
The writ petitions, announced on 16 July 2026, were filed against Calexico, Costa Mesa, Half Moon Bay, Ridgecrest and Turlock following referrals from the California Department of Housing and Community Development.
The proceedings form part of an enforcement programme led by Bonta, Governor Gavin Newsom and HCD during California’s sixth housing element update cycle. Each city and county must revise its housing plan every eight years to accommodate its Regional Housing Needs Allocation.
The current cycle requires local authorities across California to plan for approximately 2.5 million additional homes. HCD says more than 95% of California communities have achieved compliance during the cycle.
Petitions were filed against Calexico in Imperial County Superior Court, Costa Mesa in Orange County Superior Court, Half Moon Bay in San Mateo County Superior Court, Ridgecrest in Kern County Superior Court and Turlock in Stanislaus County Superior Court.
According to the Attorney General’s Office, HCD issued notices of violation and written findings, gave each city 30 days to respond and offered two meetings to discuss corrective measures before referring the cases for enforcement. The petitions ask the courts to compel the cities to meet their statutory obligations.
The legal consequences may extend beyond an order requiring a compliant plan. Senate Bill 1037, sponsored by Bonta and effective since 1 January 2025, makes local governments liable for monthly civil penalties when they fail to comply on time. Money collected is deposited into the Building Homes and Jobs Trust Fund to support affordable housing in the affected jurisdiction.
Noncompliance can also trigger the Builder’s Remedy under California’s Housing Accountability Act, limiting a local authority’s ability to reject certain developments containing prescribed levels of low- or moderate-income housing because they conflict with existing zoning or land-use designations. The cities may seek to resolve the claims through consent decrees or stipulated judgments establishing accelerated compliance timetables.
Solicitors and barristers following US public-law litigation will be watching California’s use of writ proceedings, civil penalties and planning remedies to enforce housing obligations. In-house counsel advising municipalities, developers and housing organisations will need to check that local plans and zoning measures meet statutory deadlines and keep a complete record of any response to HCD findings.
Cities may resolve the proceedings through consent decrees or stipulated judgments setting an agreed timetable for compliance. Continued delay could leave local governments liable for monthly penalties under Senate Bill 1037 and restrict their ability to reject certain development applications under the Builder’s Remedy.
Law firms instructed after HCD issues a notice of violation will need to establish what remains outstanding and whether the authority can reach agreement before proceedings are filed. Rob Bonta and the Newsom Administration have said that further writ petitions may follow against cities and counties that remain out of compliance.
